Sports lawyer Majani reveals why Kenyan clubs are losing cases at FIFA

Majani blamed ignorance and an inability to live within their means as the major points that start the problems.
Sports lawyer Elvis Majani has asked local clubs to sign only players they can afford to avoid the constant litigation that has caused some teams millions of shillings in fines.
Speaking in the wake of Gor Mahia’s exclusion from the CAF Champions League for failing to pay three of their former players, Majani said, ”Our clubs must learn to live within their means to avoid such problems in future.”
“You find some teams offer player salaries they cannot sustain for more than three months and then problems begin,” he added.

Further, Majani blamed ignorance claiming that some clubs portray a don’t care attitude and tell off the players who demand their dues instead of talking to them.
“There is an attitude of what will you do from some teams and once it gets out of hand, it becomes impossible to handle it from there on,” he noted.
He also revealed that some clubs either do not put a defense or put in a weak one leading to them being punished.
“From my interaction with such matters, only one club in the Football Kenya Federation Premier League (FKFPL) always bother to put up a defense when faced by such matters. The others either don’t put one or when they do, it is weak and does not address the issues raised by players,” he said.
Majani hopes the current situation will be a big lesson to all the local clubs whom he insisted must now start treating local players equally better.
“Most of the cases we have seen involve foreign players. I would love to see Football Kenya Federation (FKF) also fighting for local players in the same way the world governing body FIFA is fighting for the others. I hope this is a lesson that will help improve the welfare of our players,” he concluded.
Apart from Gor Mahia, AFC Leopards have also been fined millions of shillings for breach of contract of their players. The club is required to pay Sh.20 million to former coach Patrick Aussems.
