Ohaga says the decision by NEC lacks legal standing.

The Sports Disputes Tribunal (SDT) has this afternoon quashed the decision by FKF’S National Executive Committee to nullify the 2021/22 leagues.

Last month, FKF nullified the leagues that were run by the FKF Transition Committee. The move resulted in the quashing of all promotions with the likes of APS Bomet and Fortune Sacco, sides that had earned a promotion to the top tier forced to go back to the second tier.

“.. Having stated the foregoing, it will be evident that by now that we have come to the conclusion that the decision of the National Executive Committee has no legal foundation, is a nullity, and cannot be sustained. It is accordingly quashed. We do not consider it necessary, therefore, to address the individual prayers sought,” he said partly while reading the ruling.

Ohaga empathized with the affected clubs as they spent a fortune to honour league matches.

“Clubs spent considerable resources in recruiting players, preparing for matches traveling to honour fixtures, and generally participating in the activities arranged by the bodies established for the purpose of running football in Kenya. The clubs were entitled to presume that their participation in those leagues was lawful and that the matches,” he said.
