Reprieve for Nairobi United as High Court grants FKF orders

United had played two matches before they were stopped from playing by the Tribunal.

The High Court sitting in Nairobi has handed Nairobi United a temporary reprieve after the Football Kenya Federation acquired leave to institute Judicial Review proceedings seeking to quash the decision of the Sports Disputes Tribunal.

In September, the tribunal ordered that Nairobi United be left out of the fixtures after Zoo FC filed a case at the tribunal challenging the ruling of FKF’s Leagues and Competitions Committee that ratified United’s promotion and slapped Zoo FC with more sanctions after the playoff match between the two sides was aborted in the final minutes.

The FKF Division One playoff that was played in Nakuru in August was abandoned in the 90th minute after fans attacked match officials in protest of the five minutes of added time that the reserve referee signaled. The FKF’s LCC found the Zoo guilty of causing abandonment, and apart from losing the game, the Zoo was docked a further three points, slapped with a KES 300,000 fine, and ordered to play their opening five home matches behind closed doors this season.

After the directions issued by the Tribunal, the federation moved to the High Court seeking to quash the ruling, and on Wednesday, they were handed orders that also served as a reprieve to Nairobi United, who have agonizingly been waiting for the white smoke from the corridors of justice.

A communiqué from the federation to clubs this evening has informed all the second-tier clubs that United will be included in this weekend’s matches.


FKF Communique.

We refer to our email dated September 27, 2023, in which we notified clubs of the SDT orders that barred Nairobi United FC from playing pending determination of the SDTSC No. E023 of 2023 regarding the promotion playoff.

We are pleased to inform you that the High Court in Nairobi has this morning granted the Federation leave to institute Judicial review proceedings seeking to quash the decision of the Sports Disputes Tribunal delivered on September 14, 2023.

In so doing, the High Court also ordered that the leave so granted shall operate as a stay of that decision of the Sports Disputes Tribunal. Consequently, the decision of the Sports Disputes Tribunal is temporarily rendered inoperative until the determination of the judicial review proceedings.

In this regard, please note that we have updated the weekend league fixtures accordingly and shall schedule round 3 and round 4 matches involving Nairobi United FC in due course.

United had played two matches before they were stopped from playing by the Tribunal. They beat the Kibera Black Stars 2-0 in the opening match of the campaign before downing the Kisumu All-Stars by a similar scoreline.
