
Parent demands for reversal of Team Manager appointment for World Aquatics Championships

The parent argues the Kenya Aquatic Federation did not follow the due process in the appointment of Winfed Warui as the team manager for the Kenya team that will head to Doha, Qatar for the World Aquatics Championships next month
A parent to a swimmer wants Kenya Aquatic Federation (KAF) compelled to drop an official it has picked as team manager to this year’s World Aquatics Championships in Doha.
Jen Monyo Maina has moved to the Sports Disputes Tribunal (SDT) to quash the appointment of Winfred Warui as team manager to the event that will be held next month.
She argues through her lawyer that the federation did not follow the laid down rules in making the appointment and wants it revoked.
“The respondent published a criteria by which a team manager was supposed to be selected but in the end they did not follow the same,” she argued through lawyer Victor Omwebu.
She also argued that despite several efforts she was not given a chance to sort out her griviences within the frame work of the constitution of the federation.
Maina insisted that she has an interest in who is appointed as team manager to the world event as he is a parent to one of the swimmers travelling to Doha and also given her role in the swimming fraternity.
In her prayers, Maina wants an alternate team manager be appointed in accordance with the published guidelines to ensure that only a qualified person is appointed to the position.
But the federation through lawyer James Kairo dismissed the application insisting that Maina lacked jurisdiction to file the suit as she did not apply for the position.
“Further, her case does not meet the public interest criteria and should therefore be dismissed,” he argued.
Kairo defended the appointment of Warui insisting that no other person applied for the position.
“It is true that we published the criteria for the appointment of a team manager but we did not send out a call for people to apply. In the end the federation had to make an appointment and we sent the same to the World body who have not rejected it,” he said.
The matter will continue next Tuesday.
