
Court hands Kariobangi Sharks reprieve in fight against FKF Premier League relegation

Lady Justice Chepkwony also rules against, among others, registering players for next season using 2025 rules
The 2018 Mozzart Bet Cup champions, Kariobangi Sharks, have been handed a major boost in their fight against relegation after the High Court issued a conservatory order against their direct relegation until a case challenging it is heard and determined.

In a matter filed before Lady Justice Dorah Chepkwony at the Murang’a High Court, the court restrained FKF from enforcing the new promotion/relegation rules, which have since been a contentious matter.
Evans Nduta moved to the court to challenge the application of the FKF Rules and Regulations Governing Football (Revised) 2025, which, if implemented, would see Sharks compete in the National Super League (NSL) next season.
Through an ex parte order, Lady Justice Chepkwony, who certified the matter as urgent, granted Nduta his major prayers, which include barring FKF from “Implementing, giving effect to, or relying upon the FKF Rules and Regulations Governing Football (Revised 2025) in administering any FKF competition, making any decision relating to the promotion or relegation of any club, or constituting any FKF competition for the 2026/2027 season on the basis of those rules,” reads the first order of the court.
According to Nduta, the contentious 2025 rules were communicated to clubs after the start of the season, as opposed to before, as required by the FKF constitution.
Nduta equally obtained orders stopping FKF from commencing the 2026/27 FKF Premier League season using the said 2025 rules, which do not have a provision for a promotion/relegation playoff and instead constitute automatic relegation and promotion of teams from the FKFPL and NSL, respectively.
Lady Justice Chepkwony also rules against, among others, registering players for next season using 2025 rules.
The Conservatory order also restricts FKF from “taking any steps, including player registration, fixture scheduling, club licensing, or league composition announcements - premised on or consequential to the purported automatic relegation and the 2025 Rules.”
The last order to this effect restricts FKF from performing any action that would render the petition nugatory and give effect to the 2025 rules.
FKF also suffered a blow after the court gave a conservatory order against its judicial bodies over what the petitioner termed an illegal constitution.
“THAT pending the hearing and determination of this Application, this Honourable Court do issue a CONSERVATORY ORDER restraining the Respondent from operating or purporting to exercise jurisdiction through the FKF Disciplinary Committee and FKF Appeals Committee as presently constituted, those bodies not having been elected and ratified by the FKF General Assembly in accordance with Article 64(4) of the FKF Constitution, 2017,” reads the court directive.
This comes after another conservatory order from the Sports Disputes Tribunal (SDT) also barred FKF from implementing the direct relegation and promotion.
